Terms of Service

These Terms of Service govern your use of the XportACar website, mobile apps and related services. By creating an account or using the platform you agree to these terms.
Important
Translations are provided for convenience. In case of discrepancy, the English version governs. This document describes the platform's policy and is not legal advice.
1. Acceptance
By creating an account or using XportACar's website or mobile apps, you agree to these Terms of Service. If you do not agree, do not use the service.
2. Account and KYC
You must be at least 18 years old to register. Before bidding, you must complete Know-Your-Customer (KYC) verification by submitting identity documents and, for business buyers, company registration documents. We may refuse, suspend or revoke accounts that fail verification or breach these terms.
3. Buyer types — B2B and B2C
XportACar is open to businesses (B2B) and consumers (B2C). If you act as a consumer resident in the EU/EEA, mandatory consumer protections under EU law — including Directive 2011/83/EU and statutory warranty rules — apply and cannot be waived by these terms. Where you act as a business, the B2B provisions of these terms apply.
4. Auction mechanics
Listings are invitations to bid, not binding offers from the seller. Once placed, a bid is binding on you for the duration of the auction. You may set a maximum (proxy) bid; the system will bid for you up to that limit. Reserve prices are not disclosed; a vehicle sells only if the highest bid meets or exceeds the reserve. Buy-Now, where offered, ends the auction immediately at the listed price.
5. Payment terms
After you win:
- You have 36 hours to confirm payment in the app and upload proof of transfer.
- Once confirmed, you have 5 working days to complete the bank wire.
- XportACar charges a 2.9% platform fee on the hammer price.
- Late or missing payment may incur charges, may result in the vehicle being re-listed and may lead to account suspension.
6. Customs, VAT and import duties
All import costs — customs duties, VAT and any other import-related taxes or charges — are the buyer's responsibility and are not included in the platform fee or shipping cost. The buyer is responsible for compliance with import regulations in the country of import.
7. Shipping
XportACar arranges shipping through partner carriers based on the option you select: warehouse pickup in Dubai, RoRo to a nominated EU port, container shipping or door-to-door delivery. Optional German TÜV / registration paperwork can be added (currently €750). Shipping costs are quoted at checkout and paid as part of the invoice.
8. Risk transfer
Risk in the vehicle passes from XportACar (or the seller) to the buyer when the vehicle is handed to the carrier nominated for the chosen shipping option, or — for warehouse pickup — when the vehicle is collected by the buyer or their agent. Insurance during transit is the buyer's responsibility unless purchased as an add-on.
9. Vehicle descriptions and inspection reports
Vehicles are pre-owned. Our inspectors document each vehicle to the best of their ability — photographs, recorded damage, paint-thickness readings and mileage. Inspection reports document the condition observed at the time of inspection and are not a manufacturer's warranty or a guarantee of fitness for any particular purpose.
10. Warranty and defects
For B2B buyers: vehicles are sold as used; we expressly exclude implied warranties of merchantability and fitness for purpose to the maximum extent permitted by applicable law. You must notify us in writing within 14 days of delivery of any material defect that was not documented in the inspection report, with photographic evidence. We will review and propose a fair resolution.
For consumer (B2C) buyers in the EU/EEA: statutory consumer warranties under your local law apply and are not affected by this clause. Nothing in these terms limits any consumer right that cannot be waived under applicable law.
11. Dispute resolution
These terms are governed by the laws of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of the courts of the Dubai Free Zones (the DIFC Courts where applicable), except where mandatory consumer-protection rules entitle an EU consumer to bring proceedings in the courts of their habitual residence.
12. Limitation of liability
To the maximum extent permitted by law, XportACar's total liability arising out of or in connection with the platform or a vehicle purchase is limited to the platform fee actually paid for the transaction concerned. We are not liable for indirect or consequential losses, including loss of profit. Nothing in this clause limits liability that cannot be limited under applicable law, including liability for fraud or for personal injury caused by negligence.
13. Intellectual property
The XportACar name, logo, website, apps and content (other than user-uploaded content and third-party material) are owned by Global Business Consultancy L.L.C-FZ. You may not copy, scrape, modify or redistribute platform content without our prior written consent.
14. Acceptable use
You agree not to:
- place fraudulent or non-binding bids ('shill bidding');
- bid on your own listings or coordinate bidding with others;
- use automated tools to scrape, crawl or load-test the platform;
- manipulate prices or interfere with the service;
- use the platform for any unlawful purpose.
We may suspend or terminate accounts that breach these rules.
15. Suspension and termination
We may suspend or close an account for breach of these terms, failure to complete KYC, repeated non-payment, suspected fraud or any other lawful reason. You may close your account at any time by contacting support; some data may be retained as set out in the Privacy Policy.
16. Changes to these terms
We may update these terms as the platform evolves or as required by law. Material changes will be announced in the apps or by email. Continuing to use the platform after changes take effect means you accept them.
17. Force majeure
Neither party is liable for delays in or failure to perform caused by events beyond reasonable control, including natural disasters, regulatory action, carrier failures, port closures or major outages of third-party infrastructure.
18. Severability
If any provision of these terms is held invalid or unenforceable by a competent court, the remaining provisions remain in full effect.
19. Governing law
These terms are governed by the laws of the United Arab Emirates. Mandatory consumer-protection rules of your country of residence (where applicable) continue to apply alongside this clause.
